Please read this PRIVACY POLICY carefully. By visiting and using this website and any websites, web pages, and services operated by Sunset Development or its affiliates and agents (“Company”,“We”, or“Us”) that are linked (“Company Sites”), you are agreeing to this privacy policy.

1. General
Your use of and access to the Company Sites is expressly conditioned on your acceptance of the following terms and conditions. If you do not or cannot agree with any part of the following terms and conditions, you may not use or access the Company Sites. Please note that this privacy policy only applies to the information that we collect via the Company Sites.

This Privacy Policy describes how Sunset Development treats data and information about you that we collect/ receive from you through the Company Sites and other aspects of Sunset Development’s business including offline, and third parties. The privacy of your nonpublic personal information is important to us. We use safeguards to protect your privacy and confidentiality. This policy discusses information we collect and the manner in which it is used. We reserve the right, at any time, to add to, change, update or modify our privacy policy simply by posting such change, update or modification on the Company Sites, including this Privacy Policy web page. Any such change, update or modification will be effective immediately upon posting on the Company Sites.

2. Security
We use good faith efforts to maintain physical, electronic and procedural safeguards to guard your nonpublic personal information. However, while we strive to protect your personal information, we do not ensure or warrant the security of any information you transmit to us, and you do so at your own risk.

3. Information Collection
If you do nothing during your visit but browse through the Company Sites and read the information contained on the web pages, we may gather certain information about your visit automatically. This information does not identify you personally. We may automatically gather the Internet domain (for example, “companyx.com” if you use a private Internet access account), IP address (an IP address is a number that is automatically assigned to your computer whenever you are accessing the Internet) from which you access Company Sites, and the date and time you access Company Sites, and the pages you visit.  We also may obtain non-personal information from social media platforms, vendors and other third parties, such as Google, Inc. (“Google”) and the operators of other Company Sites or applications that run on mobile devices and tablets (“applications”) that you have visited, some of which partner with Us or with a display network utilized by Us, and may share information as permitted in such third party’s privacy policy. Non-personal information may also be obtained from inferences based upon the sites you visit, third party data, information you share on other Company Sites, social media platforms and applications, or demographics derived from profiles you create, such as a Google profile.

We may collect nonpublic personal information from you when you voluntarily provide personally identifiable information to us through Company Sites, such as when submitting a work order, enrolling for an event or service, or entry into a sweepstakes, contest or drawing.  When you register to request information on a Company Sites or make purchases on a Company Site you are submitting personal information. Once you use these features of the Company Sites, you are not anonymous to us.

Sunset Development may acquire personal information from publicly available sources, social media platforms, and vendors and other third parties that may share information as permitted in their privacy policies.

We may combine personal information collected as described above with information available from other sources (such as offline records or publicly available information). If the combined information permits us to contact you online or offline, we will treat the combined information as personal information.

We reserve the right to use this collected information for marketing/product development research and other similar purposes, and/or to contact you regarding additional services or products that you may find useful.

We may also release your information to others when we believe, in good faith, that such release is reasonably necessary to (i) comply with law, (ii) enforce or apply the terms of any of our user agreements, or (iii) protect the rights, property or safety of Company, Company’s users, or others. We may also sell, transfer and disclose your information part of a business divestiture, sale, merger, or acquisition of all or a part of our business.

i. Cookies and other “Collection Technology”
Non-personal information may be collected in a variety of ways, but Collection Technology is often used. “Collection Technology” refers to cookies, web beacons, pixels, gifs, tags and other technologies that collect information in similar ways. Collection Technology such as a cookie may store a piece of data on your browser or device, while other forms of Collection Technology may identify your browser or device and/or collect information through other means. When you visit the Company Sites or another website or application where a Sunset Development ad appears, your browser or device may be exposed to Collection Technology and Collection Technology may be stored on your browser or device, which may provide Us with non-personal information about you.

You may delete and/or refuse the use of certain Collection Technologies by selecting the appropriate settings on your browser. You may use the Company Sites even if you choose to refuse or delete such Collection Technologies; however please note that this may affect your ability to use the full functionality of the Company Sites.

ii. Google Analytics
The Company Sites utilize Google Analytics, a web analytics service provided by Google. Google Analytics uses Collection Technology to collect and store anonymous information about you, which may include the non-personal information described above. You can read Google Analytics’ privacy policy at http://www.google.com/analytics/learn/privacy.html and Google Analytics Terms of Use at http://www.google.com/analytics/tos.html. The Company Sites use these features of Google Analytics:

(a) “Demographics and Interest Reporting” to analyze information regarding the interests and demographics of users of the Company Sites. We use such non-personal information in the same manner in which used for other non-personal information as described below.

(b) “Remarketing with Google Analytics” to place ads on other sites directed to people who have visited the Company Sites.

(c) “Google Display Network Impression Reporting” to report how people’s interactions with Sunset Development ads relate to their visits to the Company Sites.

You can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads by changing the ad settings here. You also can opt-out from being tracked by Google Analytics in the future by downloading and installing Google Analytics Opt-out Browser Add-on for your current web browser here.

4. Employees
Our employees and agents may view information that you provide us in order to perform their jobs and service you, including customer service, update of account information, posting of Submissions, informing you of products or services that may be of interest to you, forwarding of updates, announcements, and newsletters, responses to your communications, communications with you about the Company Sites, Submissions and other activities related to the Company Sites.  Through entering into these interactions with Sunset Development, you authorize Sunset Development to transmit email to you concerning these matters. We do not authorize access to nonpublic personal information about you to those individuals who do not need to know this information in order to provide products or services to you, or as otherwise provided herein. 

5. Sharing andDisclosure of Personal Information
We may disclose any information that we collect about you to our affiliates or nonaffiliated third parties as permitted by law. We also may disclose information about our customers or former customers and others to the following types of nonaffiliated companies that perform marketing services on our behalf or with whom we have joint marketing agreements:

Non-financial companies such as event coordinators, fulfillment houses, and transportation services.

i. Disclosures Under Special Circumstances
Sunset Development may provide information about you in response to or to cooperate with law enforcement, government requests, subpoenas, court orders or legal process; to respond to your requests for customer service or other information; to enforce the
Terms of Use; to establish or exercise our legal rights or defend against legal claims; or to protect the safety or property of Sunset Development or others. Sunset Development may also provide information about you if we believe it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required or permitted by law.

6. Protection of Personal Information
Sunset Development stores personal information using industry standard, reasonable and technically feasible physical, technical and administrative safeguards against foreseeable risks, such as unauthorized access.

Please be aware that the Company Sites and data storage are run on software, hardware and networks, any component of which may, from time to time, require maintenance or experience problems or breaches of security beyond Sunset Development’s control. Sunset Development is not responsible for the acts and omissions of any third party Website or data storage provider.

We cannot guarantee the security of the information on and sent to you from the Company Sites. No transmission of data over the internet is guaranteed to be completely secure. It may be possible for third parties not under the control of Sunset Development to intercept or access transmissions or private communications unlawfully. While we strive to protect your personal information, neither Sunset Development nor any of our Service Providers can ensure or warrant the security of any information you transmit to us over the internet. Any such transmission is done at your own risk.

7. Notice of Privacy Rights of California Residents
If you are a California resident and have provided personal information to Sunset Development, you are entitled by law to request certain information regarding any disclosure by Sunset Development to third parties of personal information for their direct marketing purposes. To make such a request, send an email webmaster@bishopranch.com, specifying that you seek your “California Customer Choice Privacy Notice.” Specify the Company Site(s) or line(s) of business to which your request pertains. Please allow thirty (30) days for a response. Sunset Development is required to respond to only one request per customer each year, and is not required to respond to requests made by means other than through the above email address.

8. Correcting or Removing Your Personal Information/Opt Out
To review or change your personal information collected by Sunset Development, please send your request, including the Company Site or line of business to which your request pertains, to webmaster@bishopranch.com or to:

If you want to unsubscribe from an email list of Sunset Development, please let us know by following the “Unsubscribe” instructions that are included in each promotional email from us. Please note that such requests may take up to ten (10) days to become effective. You may not opt out of receiving communications regarding your purchases, transactions, dealings with the Company Sites, or technical information collected (such as IP address) by the Company Sites.

9. Children
Sunset Development is committed to protecting the privacy of children. The Company Sites are directed to persons 18 years of age or older. We do not knowingly collect information from children under age 18. If you under age 13, you are not permitted to use the Company Sites or to submit any personally identifiable information to the Company Sites. If you provide information to us, you represent and warrant to us that you are 18 years of age or older. If you are 13 – 17 years of age, you may visit, browse and use the information on the Company Sites, but you may not submit any personal information to the Company Sites and you represent and warrant to us that you have permission of your parent or guardian to use the Company Sites and any activities on the Company Sites, who agrees to these Terms on your behalf. If we become aware that a Company Site visitor is under age 18 and has provided personal information, we will remove his or her personal information from our files. If you are a parent or guardian and believe we may have inadvertently collected personal information from your child, please notify us immediately by sending an email, including the Company Site or line of business to which your request pertains, to webmaster@bishopranch.com.  

10. Links To Other Websites
Company Sites may contain links to websites that are provided and maintained exclusively by third parties and are not subject to this privacy policy. Please review the privacy policies on those websites to understand their personal information handling practices. We make no representations concerning the privacy policies of these third party websites. This Privacy Policy only applies to information collected and maintained by Sunset Development.

11. Third Party Postings
From time to time certain third parties, such as our tenant companies, with whom Sunset Development has a business relationship, may post information such as job postings on our Company Sites. Sunset Development is not responsible for the content of these postings, or for ensuring that the third parties comply with this Privacy Policy.

12. Governing Law
This Privacy Policy shall be governed by, and will be construed under, the laws of the State of California, U.S.A., without regard to choice of law principles. Those who choose to access the Company Sites from locations outside of the United States do so on their own initiative, and are responsible for compliance with local laws if and to the extent local laws are applicable, including without limitation, all applicable laws, rules and regulations regarding the transmission of data exported from the United States or the country in which you reside. We may limit a Company Site’s availability, in whole or in part, to any person, geographic area or jurisdiction, at any time at our sole discretion.

Personal information collected through the Company Sites and other aspects of Our business may be stored and processed in the United States or any other country in which We or Our affiliates, subsidiaries or Service Providers maintain facilities. By using the Company Sites, you expressly consent to such transfer of information.

1) Acceptance of Terms of Use

Please carefully read the following Terms before using www.CityCenterBishopRanch.com, or any websites, web pages or services (“Company Sites”) operated by Sunset Development or its affiliates and agents (“Company”, “We”, or “Us”). By accessing our Company Site(s), you acknowledge that you have read, understood and agree to be bound by these Terms which form an agreement that is effective as if you had signed it. If at any time you do not agree to these Terms, please do not access or use our Company Sites(s) or any of its content.

Your access to, use of and browsing of  Company Sites content are subject to all terms contained herein and Our Privacy Policy and all applicable laws and regulations.  If you do not agree to these terms of use, your permission to access or use our Company Sites is revoked.

2) Age Restrictions

The Company Sites are directed to persons 18 years of age or older. Sunset Development does not knowingly collect information from children under age 18. 

3) Permitted Use of Company Sites

The content available through the Company Sites, including without limitation text, graphics, logos, icons, images, media, data, audio, animation, videos, charts, maps, software and other information and materials (collectively, the “Content”) is the sole and exclusive property of Sunset Development and/or its licensors. You agree not to reproduce, duplicate, modify, copy, sell, resell or exploit for any commercial purpose, any portion of the Company Sites or the Content other than as expressly authorized by Sunset Development in writing. Use of the Company Sites or the Content in any way not expressly permitted by these Terms is prohibited, and may be actionable under United States or international law. You agree not to access the Company Sites by any means other than through a standard web browser.

You may not duplicate, publish, display, modify, distribute, perform, reproduce, copy, sell, resell, exploit, or create derivative works from any part of the Company Sites or the Content unless expressly authorized by Sunset Development in writing. You agree that you will not remove, obscure, or modify any acknowledgements, credits or legal, intellectual property or proprietary notices, or marks, or logos contained on the Company Sites or in the Content.

4) Restricted Access

Some Company Sites may restrict access to the sites or to sections or features of the sites. A separate agreement that addresses access and use may apply to those sites, sections or features may apply. In the event that you are required to select a username or password to access those sites, sections or features, you are responsible for maintaining the confidentiality of your password and are fully responsible for all uses of your password, whether by you or others. You authorize Us to act on instructions received through use of your password, and agree that We are not liable for any loss or damage arising from your failure to comply with this Section. You agree to immediately notify Us of any unauthorized use of your password or any other breach of security.

5) Privacy Policy

Please review the Privacy Policy for the Company Sites. If you do not agree with the Privacy Policy, then you are not authorized to use the Company Sites. The terms of the Privacy Policy are incorporated herein by this reference.

6) Proprietary Rights

You acknowledge and agree that, as between Sunset Development and you, all right, title, and interest in and to the Company Sites and the Content – including images unless otherwise indicated -, and also without limitation any patents, copyrights, trademarks, trade secrets, inventions, know-how, and all other intellectual property rights are owned exclusively by Sunset Development or its licensors, are valid and enforceable, and are protected by United States intellectual property laws and other applicable laws.

All Content included in the Company Sites is the copyright and property of Sunset Development or its content suppliers and protected by U.S. and international copyright laws. Permission is granted to electronically copy and print hard copy portions of the Company Sites for the sole purpose of using the Company Sites as a personal or internal resource or otherwise for its intended purposes. Any other use, including the reproduction, modification, distribution, transmission, re-publication, display or performance, of the Content of the Company Sites, is strictly prohibited.

Trademarks:

The Bishop Ranch logo and trade names and trade dress used on the Company Sites are proprietary to Sunset Development or its licensors and any third party names or trademarks referenced in the Company Sites do not constitute or imply affiliation, endorsement or recommendation by Sunset Development, or of Sunset Development by the third parties.

6) Your Indemnity of Sunset Development

You agree to indemnify, defend and hold Sunset Development, its officers, directors, employees, agents, subsidiaries, affiliates, licensors, service providers and others acting in concert with it, harmless from any loss, liability, claim or demand, including without limitation reasonable attorneys’ fees, made by you or on your behalf or by any third party due to or arising out of (a) your connection or submission to or use of the company sites or the content; or (b) your violation of these terms of use, any applicable laws, or the rights of Sunset Development or any third party.

Prohibited Actions: You agree that the following actions are prohibited and constitute a material breach of these Terms. This list is not meant to be exhaustive, and Sunset Development reserves the right to determine what types of conduct it considers to be inappropriate use of the Company Sites. In the case of inappropriate use, Sunset Development or its designee may take such measures as it determines in its sole discretion.

By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

1. Use the Company Sites or the Content for any purpose or to take any actions in violation of local, state, national, or international laws, regulations, codes, or rules.
2. Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
3. Take any action that imposes an unreasonable or disproportionately large load on a Company Sites’ infrastructure or otherwise in a manner that may adversely affect performance of the Company Sites or restrict or inhibit any other user from using and enjoying the Communication Services or the Company Sites.
4. Use any Company Sites for unauthorized framing or linking, or via automated devices, bots, agents, scraping, scripts, intelligent search or any similar means of access to the Content.
5. Aggregate, copy, duplicate, publish, or make available any of the Content to third parties outside the Company Sites in any manner.
6. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
7. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material, content, or information.
8. Upload or download files that contain software or other material protected by intellectual property laws or other laws, unless you own or control the rights, titles, or interests thereto or have received all necessary consents or rights.
9. Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
10. Use any Company Sites to make available unsolicited advertising or promotional materials, spam, pyramid schemes, chain letters, or similar forms of unauthorized advertising or solicitation.
11. Harvest or otherwise collect information about others, including email addresses and other personal information, without their consent.
12. Falsify or delete any author attributions, legal or other notices, or proprietary designations or labels of origin or source.
13. Engage in any other action that, in the judgment of Sunset Development, exposes it or any third party to potential liability or detriment of any type.

You understand that by using the Company Sites, you may be exposed to User Materials that you may consider offensive or objectionable. You agree that you must evaluate, and bear all risks associated with, the use or exposure to any User Materials posted by others. You further acknowledge and agree that you will not rely on any Content or User Materials available on or through the Company Sites.

7) Modifications to the Company Sites

Sunset Development reserves the right at any time and from time to time to modify, suspend, or discontinue, temporarily or permanently, the Company Site(s), or any portion thereof, with or without notice. You agree that Sunset Development will not be liable to you or to any third party for any modification, suspension, or discontinuance of any Company Site(s).

8) Suspension and Termination Rights

We reserve the right, at our sole discretion, immediately and without notice, to suspend or terminate your access to the Company Sites or any part thereof for any reason, including without limitation any breach by you of these Terms. You agree that Sunset Development shall not be liable to you or any third party for any such suspension or termination.

9) Links

Links to Other Company Sites and Search Results: The Company Sites may contain links to websites operated by other parties. The Company Sites provide these links to websites as a convenience, and your use of these websites is at your own risk. These linked non-Sunset Development websites are not under the control of Sunset Development and we are not responsible for the content contained herein. Such links do not imply endorsement of information or material on any other website and We disclaim all liability with regard to your access to, use of or transactions with such linked websites. You acknowledge and agree that We are responsible or liable, directly or indirectly, for any damage, loss or other claim caused, or alleged to be caused by or in connection with or access to, or reliance of any content available on or through any non-Sunset Development website or resource.

Links to the Company Sites: You may link another website to a Company Site subject to the following linking policy: (i) the appearance, position and other aspects of any link may not be such as to damage or dilute the reputation of Sunset Development or the Company Site linked to; (ii) the appearance, position and other attributes of the link may not create the false appearance that your site, business, organization or entity is sponsored by, endorsed by, affiliated with, or associated with Sunset Development or the Company Site linked to; (iii) when selected by a user, the link must display the Company Sites on full-screen and not within a “frame” on the linking from website; and (iv) We reserve the right to revoke our consent to the link at any time and at our sole discretion. You agree to remove the link if We exercise our right to revoke its consent.

10) Disclaimer

The company sites and content and the information, offered, contained in or advertised on the company sites, including without limitation text, video, graphics and links, are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. to the maximum extent permitted by law, Sunset Development and its licensors, suppliers and related parties disclaim all representations and warranties, express or implied, with respect to such information, services, products and materials, including, but not limited to, warranties of merchantability or fitness for a particular purpose, title, non-infringement, freedom from computer virus and implied warranties arising from course of dealing or course of performance. Your use of the company sites and any content is entirely at your own risk.

Without limiting the foregoing, you are responsible for taking all necessary precautions to insure that any Content or access to the Company Sites is free of viruses or other harmful code.

11) Limitation on Liability

To the maximum extent permitted by law, Sunset Development and its related parties disclaim all liability, whether based in contract, tort (including without limitation negligence), strict liability or any other theory arising out of or in connection with the company sites, use, inability to use or performance of the information, content, services, products and materials available from or through the company sites. In no event shall Sunset Development or any of its licensors, suppliers or related parties be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages, even if these entities have been previously advised of the possibility of such damages. These limitations shall apply notwithstanding any failure of essential purpose or the existence of any limited remedy. Without limiting the foregoing, the maximum aggregate liability of Sunset Development arising out of or in connection with these terms or the company sites or the content, information, materials, products or services on or through the company sites shall not exceed fifty dollars (U.S.).

Exclusions and Limitations: Because some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you. This Limitation of Liability shall be to the maximum extent permitted by applicable law.

12) Notice Required by California Law

Pursuant to California Civil Code Section 1789.3, users are entitled to the following specific consumer rights notice:

13) Governing Law and Disputes

These Terms shall be governed by, and will be construed under, the laws of the State of California, U.S.A., without regard to choice of law principles. You irrevocably agree that the exclusive venue for any disputes arising between you and Sunset Development out of, under, or in connection with these Terms, the Company Sites or their Content shall be general reference proceedings conducted in Orange County, California, U.S.A., which venue is the most convenient and appropriate for the resolution of disputes concerning these Terms. Any such dispute shall be settled in accordance with the decision of the referee rendered as provided for in Part 1, Title 8, Chapter 6, § 638(a) of the California Code of Civil Procedure, or any successor California statute governing resolution of disputes by a court-appointed referee without a jury. Any cause of action or claim you may have with respect to these Terms, the Company Sites or their Content must be commenced within six (6) months after the claim or cause of action arises or such claim or cause of action shall be barred. Without limiting the foregoing, you agree that to the fullest extent permitted by law: (1) no claims by you shall be joined with any other and you agree not to participate in any claim brought by others; (2) you have no right or authority for any dispute to be litigated on a class-action basis or to utilize class action procedures; and (3) you have no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

You agree that any dispute between you and Sunset Development arising out of or relating to these Terms, the Privacy Policy, the Company Sites or their Content will be decided only by arbitration, individually and not on a class-wide basis. You knowingly waive any right to participate in any form of “class,” “joint” or “representative” litigation (including in any “private attorney general capacity”) against Sunset Development. The laws of the State of California, U.S.A., without regard to choice of law principles, shall apply to any dispute between us, except as to matters relating to arbitration, which shall governed by the Federal Arbitration Act..

The Company Sites is controlled within the United States of America and directed to individuals residing in the United States. Those who choose to access the Company Sites from locations outside of the United States do so on their own initiative, and are responsible for compliance with local laws if and to the extent local laws are applicable. Sunset Development does not represent that the Company Sites or Content are appropriate outside the United States of America. Sunset Development reserves the right to limit the availability of the Company Sites to any person, geographic area or jurisdiction at any time in its sole discretion.

14) Force Majeure

Sunset Development shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control or unforeseen circumstances such as acts of nature or God, fire, flood, earthquake, accidents, strikes, war, terrorism, governmental act, failure of or interruption in common carriers (including without limitation Internet service providers, e-mail service providers and web hosting providers) or utilities, or shortages of transportation facilities, fuel, energy, labor or materials.

15) Miscellaneous

These Terms and the Privacy Policy set forth the entire understanding and agreement between you and Sunset Development with respect to the subject matter hereof. If any provision of the Terms or the Privacy Policy is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and that other provisions of the Terms or the Privacy Policy shall remain in full force. Sunset Development’s failure to act with respect to any failure by you or others to comply with these Terms or the Privacy Policy does not waive its right to act with respect to subsequent or similar failures. You may not assign or transfer these Terms or the Privacy Policy or your rights or obligations under these Terms or the Privacy Policy without the prior written consent of Sunset Development, and any assignment or transfer in violation of this provision shall be null and void. There are no third party beneficiaries to these Terms or the Privacy Policy.
