Please read this Privacy Policy carefully. By visiting and using this website and any websites, web pages, and services operated by Sunset Development or its affiliates and agents (“Company”,“We”, or“Us”) that are linked (“Company Sites”), you are agreeing to this privacy policy.

1. General

Your use of and access to the Company Sites is expressly conditioned on your acceptance of the following terms and conditions. If you do not or cannot agree with any part of the following terms and conditions, you may not use or access the Company Sites. Please note that this privacy policy only applies to the information that we collect via the Company Sites.

This Privacy Policy describes how Sunset Development treats data and information about you that we collect/ receive from you through the Company Sites and other aspects of Sunset Development’s business including offline, and third parties. The privacy of your nonpublic personal information is important to us. We use safeguards to protect your privacy and confidentiality. This policy discusses information we collect and the manner in which it is used. We reserve the right, at any time, to add to, change, update or modify our privacy policy simply by posting such change, update or modification on the Company Sites, including this Privacy Policy web page. Any such change, update or modification will be effective immediately upon posting on the Company Sites.

2. Security

We use good faith efforts to maintain physical, electronic and procedural safeguards to guard your nonpublic personal information. However, while we strive to protect your personal information, we do not ensure or warrant the security of any information you transmit to us, and you do so at your own risk.

3. Information Collection

If you do nothing during your visit but browse through the Company Sites and read the information contained on the web pages, we may gather certain information about your visit automatically. This information does not identify you personally. We may automatically gather the Internet domain (for example, “companyx.com” if you use a private Internet access account), IP address (an IP address is a number that is automatically assigned to your computer whenever you are accessing the Internet) from which you access Company Sites, and the date and time you access Company Sites, and the pages you visit. We also may obtain non-personal information from social media platforms, vendors and other third parties, such as Google, Inc. Non-personal information may also be obtained from inferences based upon the sites you visit, third party data, information you share on other Company Sites, social media platforms and applications, or demographics derived from profiles you create, such as a Google profile.

We may collect nonpublic personal information from you when you voluntarily provide personally identifiable information to us through Company Sites, such as when submitting a work order, enrolling for an event or service, or entry into a sweepstakes, contest or drawing. When you register to request information on a Company Sites or make purchases on a Company Site you are submitting personal information. Once you use these features of the Company Sites, you are not anonymous to us.

Sunset Development may acquire personal information from publicly available sources, social media platforms, and vendors and other third parties that may share information as permitted in their privacy policies.

We may combine personal information collected as described above with information available from other sources (such as offline records or publicly available information). If the combined information permits us to contact you online or offline, we will treat the combined information as personal information.

We reserve the right to use this collected information for marketing/product development research and other similar purposes, and/or to contact you regarding additional services or products that you may find useful.

We may also release your information to others when we believe, in good faith, that such release is reasonably necessary to (i) comply with law, (ii) enforce or apply the terms of any of our user agreements, or (iii) protect the rights, property or safety of Company, Company’s users, or others. We may also sell, transfer and disclose your information part of a business divestiture, sale, merger, or acquisition of all or a part of our business.

i. Cookies and other “Collection Technology”

Non-personal information may be collected in a variety of ways, but Collection Technology is often used. “Collection Technology” refers to cookies, web beacons, pixels, gifs, tags and other technologies that collect information in similar ways. Collection Technology such as a cookie may store a piece of data on your browser or device, while other forms of Collection Technology may identify your browser or device and/or collect information through other means. When you visit the Company Sites or another website or application where a Sunset Development ad appears, your browser or device may be exposed to Collection Technology and Collection Technology may be stored on your browser or device, which may provide Us with non-personal information about you.

You may delete and/or refuse the use of certain Collection Technologies by selecting the appropriate settings on your browser. You may use the Company Sites even if you choose to refuse or delete such Collection Technologies; however please note that this may affect your ability to use the full functionality of the Company Sites.

ii. Google Analytics

The Company Sites utilize Google Analytics, a web analytics service provided by Google. Google Analytics uses Collection Technology to collect and store anonymous information about you, which may include the non-personal information described above. You can read Google Analytics’ privacy policy and Google Analytics Terms of Use. The Company Sites use these features of Google Analytics:

(a) “Demographics and Interest Reporting” to analyze information regarding the interests and demographics of users of the Company Sites. We use such non-personal information in the same manner in which used for other non-personal information as described below.

(b) “Remarketing with Google Analytics” to place ads on other sites directed to people who have visited the Company Sites.

(c) “Google Display Network Impression Reporting” to report how people’s interactions with Sunset Development ads relate to their visits to the Company Sites.

You can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads by changing the ad settings here. You also can opt-out from being tracked by Google Analytics in the future by downloading and installing Google Analytics Opt-out Browser Add-on for your current web browser here.

4. Employees

Our employees and agents may view information that you provide us in order to perform their jobs and service you, including customer service, update of account information, posting of Submissions, informing you of products or services that may be of interest to you, forwarding of updates, announcements, and newsletters, responses to your communications, communications with you about the Company Sites, Submissions and other activities related to the Company Sites. Through entering into these interactions with Sunset Development, you authorize Sunset Development to transmit email to you concerning these matters. We do not authorize access to nonpublic personal information about you to those individuals who do not need to know this information in order to provide products or services to you, or as otherwise provided herein.

5. Sharing and Disclosure of Personal Information

We may disclose any information that we collect about you to our affiliates or nonaffiliated third parties as permitted by law. We also may disclose information about our customers or former customers and others to the following types of nonaffiliated companies that perform marketing services on our behalf or with whom we have joint marketing agreements:

Non-financial companies such as event coordinators, fulfillment houses, and transportation services.

i. Disclosures Under Special Circumstances

Sunset Development may provide information about you in response to or to cooperate with law enforcement, government requests, subpoenas, court orders or legal process; to respond to your requests for customer service or other information; to enforce the Terms of Use; to establish or exercise our legal rights or defend against legal claims; or to protect the safety or property of Sunset Development or others. Sunset Development may also provide information about you if we believe it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required or permitted by law.

6. Protection of Personal Information

Sunset Development stores personal information using industry standard, reasonable and technically feasible physical, technical and administrative safeguards against foreseeable risks, such as unauthorized access.

Please be aware that the Company Sites and data storage are run on software, hardware and networks, any component of which may, from time to time, require maintenance or experience problems or breaches of security beyond Sunset Development’s control. Sunset Development is not responsible for the acts and omissions of any third party Website or data storage provider.

We cannot guarantee the security of the information on and sent to you from the Company Sites. No transmission of data over the internet is guaranteed to be completely secure. It may be possible for third parties not under the control of Sunset Development to intercept or access transmissions or private communications unlawfully. While we strive to protect your personal information, neither Sunset Development nor any of our Service Providers can ensure or warrant the security of any information you transmit to us over the internet. Any such transmission is done at your own risk.

7. Notice of Privacy Rights of California Residents

If you are a California resident and have provided personal information to Sunset Development, you are entitled by law to request certain information regarding any disclosure by Sunset Development to third parties of personal information for their direct marketing purposes. To make such a request, send an email webmaster@bishopranch.com, specifying that you seek your “California Customer Choice Privacy Notice.” Specify the Company Site(s) or line(s) of business to which your request pertains. Please allow thirty (30) days for a response. Sunset Development is required to respond to only one request per customer each year, and is not required to respond to requests made by means other than through the above email address.

8. Correcting or Removing Your Personal Information/Opt Out

If you want to unsubscribe from an email list of Sunset Development, please let us know by following the “Unsubscribe” instructions that are included in each promotional email from us. Please note that such requests may take up to ten (10) days to become effective. You may not opt out of receiving communications regarding your purchases, transactions, dealings with the Company Sites, or technical information collected (such as IP address) by the Company Sites.

9. Children

Sunset Development is committed to protecting the privacy of children. The Company Sites are directed to persons 18 years of age or older. We do not knowingly collect information from children under age 18. If you under age 13, you are not permitted to use the Company Sites or to submit any personally identifiable information to the Company Sites. If you provide information to us, you represent and warrant to us that you are 18 years of age or older. If you are 13–17 years of age, you may visit, browse and use the information on the Company Sites, but you may not submit any personal information to the Company Sites and you represent and warrant to us that you have permission of your parent or guardian to use the Company Sites and any activities on the Company Sites, who agrees to these Terms on your behalf. If we become aware that a Company Site visitor is under age 18 and has provided personal information, we will remove his or her personal information from our files. 11. Third Party Postings

From time to time certain third parties, such as our tenant companies, with whom Sunset Development has a business relationship, may post information such as job postings on our Company Sites. Sunset Development is not responsible for the content of these postings, or for ensuring that the third parties comply with this Privacy Policy.

12. Governing Law

This Privacy Policy shall be governed by, and will be construed under, the laws of the State of California, U.S.A., without regard to choice of law principles. Those who choose to access the Company Sites from locations outside of the United States do so on their own initiative, and are responsible for compliance with local laws if and to the extent local laws are applicable, including without limitation, all applicable laws, rules and regulations regarding the transmission of data exported from the United States or the country in which you reside. We may limit a Company Site’s availability, in whole or in part, to any person, geographic area or jurisdiction, at any time at our sole discretion.

Personal information collected through the Company Sites and other aspects of Our business may be stored and processed in the United States or any other country in which We or Our affiliates, subsidiaries or Service Providers maintain facilities. By using the Company Sites, you expressly consent to such transfer of information.

Media
